Here’s how probate is calculated in Ontario:

  1. First $50,000 of the Estate’s Value
    • No probate tax is applied to the first $50,000 of the estate’s value.
  2. Estate Value Above $50,000
    • A tax of 1.5% (or $15 per $1,000) applies to the portion of the estate that exceeds $50,000.

If the total value of the estate is more than $50,000:
Probate Fee = (Estate Value−50,000) × 0.015

For example:

  • Estate valued at $1,000,000:
    (1,000,000 − 50,000) × 0.015 = 14,250
    The probate fee would be $14,250.

What Counts as Part of the Estate?

Probate is based on the fair market value of all assets within the deceased’s estate that require probate to be distributed. This often includes:

  • Real estate (located in Ontario, minus any mortgages).
  • Bank accounts.
  • Investments.
  • Personal property (e.g., vehicles, jewelry, or collectibles).

Exclusions
